The following Privacy Policy (the "Policy") applies to Arxada AG and all its global affiliates including Troy Corporation (“Troy”) and Enviro Tech Chemical Services, Inc. (“Enviro Tech”). “Arxada” or “we” as used in this Policy refers to the Arxada group including Troy and Enviro Tech.
Arxada strongly encourages you to take the time to become familiar with this Policy because it contains important information about how and why we collect, store, use and share your Personal Information (as defined below) when you request products or services offered by Arxada, including through this website (the "Services"). It also explains your rights in relation to your Personal Information and how you can contact us or a regulator if you have any concerns.
The Policy is also designed to tell you about the Personal Information we gather while you are browsing our website and how we use the Personal Information you provide to us when creating an Arxada account, when you use a form or when you contact us. Additionally, please note that on our website there may be links to other websites, tools or services owned or offered by third parties. Third-party providers may provide some services such as credit card, registration, payment or settlement services and, if used, those services may be subject to those third-party provider’s privacy policies, which we recommend you read. This Policy does not apply to those third-party websites, tools or services and we have no responsibility for them or for Personal Information provided by a user through them.

2. Definition of Personal Information
"Personal Information" means information that can directly or indirectly lead to the identification of a living person, such as an individual’s name, address, IP address, e-mail, telephone number, license number, medical identification number, financial account information or other identifying characteristic. The identification can occur by reference to one or more factors specific to the individual’s physical, physiological, mental, economic, cultural or social identity. Personal Information does not include information that has been anonymized.
3. How Arxada collects and uses your Personal Information
Arxada collects Personal Information that you provide to us, for example, when you create an Arxada account, issue a request for an information form, order products or access any of the Services. In those instances, Personal Information is required to process your request. If you decide not to provide the Personal Information, this may delay or prevent us from processing your request accordingly.
Arxada may also collect Personal Information about you in connection with your use of the Services by using cookies on its websites. This is explained in more detail in our Cookie Policy, which can be found within the Arxada Policy hub.
Furthermore, when you access Arxada’s websites, the servers automatically record information provided by your browser. Generally, this information is automatically provided by you whenever you access any website. Some of this information is not necessarily considered Personal Information, but is recorded in a server log, and may include your particular information, including, without limitation, IP address, browser software, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, language, date/time of access, length of visits to particular pages, page interaction data (such as scrolling, clicks and mouse-overs), methods used to browse away from the page, and any phone number used to call the contact phone number provided on the website as well as other information and/or cookies that will uniquely identify your computer and the Internet browser you are using.
Besides, we may also use publicly accessible information to verify information given to us and to manage and expand our business. This might include information on LinkedIn, Xing and other websites.
The Personal Information we collect may include, without limitation, the following:
· Contact information: Such as your name, job title, company name, department, e-mail address, physical mailing address and telephone number, fax number, as well as any other contact information provided in a contact form, registration or application process, during tradeshows or other events, or in connection with customer information services;
· Professional information: Such as your employment background, job description and related information, testimonials, references, as well as any other information provided during a registration or application process, and your professional online presence (e.g. your LinkedIn profile);
· Your age, to confirm you are over the age of 18;
· Your gender, if you choose to disclose this to us;
· Transaction information: Such as your contact information, the Services you are interested in, your purchasing requirements, your financial information including credit card or other payment information, purchase history, shopping cart information and information provided to customer service personnel or through customer service tools of Arxada, and which is needed in connection with the Services; and,
· Responses to surveys: Information you provide in responding to a survey on the website, via an app or email, on the telephone or otherwise, including responses provided through third-party survey services used by Arxada.
As we take appropriate measures to provide accuracy in the handling of Personal Information, we will rely entirely on you to provide correct, complete and accurate Personal Information and to update this information when required.
4. How and why we use your Personal Information & when we share your Personal Information
General overview
Arxada only processes your Personal Information to the extent permitted by applicable law. The processing of your Personal Information will therefore always be based on one of the following grounds:

· The processing is needed to comply with our legal and/or regulatory obligation;
· The processing is needed for the performance of a contract with you or to take steps at your request before entering into a contract; or,
· The processing is necessary for the purposes of our legitimate interests or those of a third party.
A legitimate interest is when we have a business or commercial reason to use your Personal Information, so long as this is not overridden by your own rights and interests. We will carry out an assessment when relying on legitimate interests, to balance our interests against your own.
You can object to processing on the basis of legitimate interests at any time. If you do so, we will stop processing your Personal Information unless we can show compelling legitimate grounds which override your rights and interests, or we need the Personal Information to establish, exercise or defend legal claims.
If we want to use your Personal Information in a manner beyond those set out in this Policy, we will usually provide you with notice of this, and, where required under applicable data protection law, ask for your consent or give you the opportunity to "opt-out" of that by using the means offered for a specific Service or sending an email to privacyofficer@arxada.com. Sometimes it may not be possible to give you notice, for example, where we have data which might be identifiable to an individual but where we do not have the means to identify you (such as an IP address or geo-location data). In some cases, we may also rely on another lawful way of processing your data which does not involve consent, for example, where the processing is necessary for compliance with a legal obligation which we are subject to.
Services
Arxada may also use Personal Information submitted by you to send you information on the Services, provided that you have subscribed to Arxada's news updates on any of its websites. In particular, Arxada as well as its service providers, consultants and agents may use your Personal Information for purposes such as:

· To provide information regarding the Services or to support your Service-related requests and related after-sales services;
· To identify you, and to contact you from time to time with updates regarding the Services;
· To manage our relationship with you and to carry out any related administration;
· To promote our Services, events, conferences, or the services, events, conferences of our partners, including by email, telephone and via social media platforms;
· To compare information for accuracy, and verify it with third parties;
· To detect, investigate and prevent activity we think may be potentially illegal, unlawful or harmful and to enforce our Policy and/or our terms or any other purpose referenced herein or therein (including but not limited to troubleshooting, data analysis and testing); and,
· To carry out research, including market research, statistical research on website traffic, sales and other commercial information to assist us in improving the Services we provide to you and tailor the website(s).
Cookies
We may process certain personal data to enable you to use our website, to ensure system security and stability, to optimise our website and deliver personalized advertising to you, and for statistical purposes. Please refer to our cookie policy for details and information on how you can opt-out of these data processing activities.
Applying to work at Arxada
If you apply to work with us, we will use the Personal Information you provide to us to process your application and to monitor recruitment statistics. If you fail to provide up-to-date and complete Personal Information when requested, this may impact the recruitment processes including the outcome of your application. If there are changes to any of the information provided in your application, please contact us immediately.
We may ask you to sign up to additional privacy terms if you apply for a job with us. Once a person has taken up employment with us, we will compile a file relating to their employment. At that stage we will give more details about how we process employee data by providing an Employee Privacy Notice.
If you apply to work with us through a third party, such as a recruitment consultant, please also check their privacy policy before proceeding. We do not encourage unsolicited approaches either directly or from third parties. For any third-party applications please do not send personal data to us unless the individual concerned has read and agrees to this Policy.
We may retain details of candidates who may be of interest to us, either now or in the future, for up to six months. If you would like us to not do that, please let us know by sending an email to privacyofficer@arxada.com. Additionally, if your circumstances change, for example, you no longer wish to be considered by us for employment, please let us know that too.
Additionally, we may use third parties to consider potential hires. We may also verify details in your application and make background checks about you if required for the role and where it is lawful to do so. These background checks may require a third party to contact you and obtain Personal Information subject to their own privacy terms.
Sharing of Personal Information within the Arxada group and with third parties
We may share Personal Information within the Arxada group when needed in connection with the purpose of processing. We may also routinely share your Personal Information with our affiliates for the following purposes:
· Personal Information about who has viewed the videos and product information available on our site may be shared with our sales force to follow-up with you regarding the video and product information content. Where you have requested a sample, we will use your information to respond to your request. We often use a third party’s software to do this collection and analysis;
· We may also provide your Personal Information to our affiliates (such as local sales entities/representatives) where they are best equipped to respond to your enquiry.
We also routinely share your Personal Information with:
· Third parties we use to help deliver our Services to you, e.g. payment service providers, warehouses and delivery companies;
· Other third parties we use to help us run our business, e.g. marketing agencies or website hosts;
· HR management platforms;
· Third parties approved by you, e.g. social media sites you choose to link your account to or third-party payment providers;
· Credit reference agencies;
· Our insurers and brokers;

Some of our website pages have buttons which allow you to share our content on social media. Again, do read their privacy policies to see what that sharing includes.
Be aware of the fact that social media companies may aggregate data you share with them with other data they hold including data from cookies, from searches and website activity and from people you associate with online. They may also use this data to send you targeted adverts or to make adverts more attractive. Social media companies may make money from this.
We or the third parties mentioned above occasionally also share Personal Information with:
· Our external auditors, e.g. in relation to the audit of our accounts;
· Our and their professional advisors (such as lawyers and other advisors); and,
· Law enforcement agencies, courts, tribunals and regulatory bodies to comply with our legal and regulatory obligations.
Arxada may also, from time-to-time, share with third parties information that contains non-Personal Information. If you have asked us to share data with third party websites (such as social media sites), their servers may not be secure. Note also that, despite the measures taken by us and the third parties we engage, the internet is not secure. As a result, others may unlawfully intercept or access private transmissions or data.
If any part of Arxada is sold, or some of its assets transferred to a third party, your Personal Information, as a valuable asset, may also be transferred to the acquirer, even if they are not in the same line of business as us. Our customer database could be sold separately from the rest of the business, in whole or in a number of parts.
Potential purchasers and their advisors may have limited access to data as part of the sale process. However, use of your Personal Information will remain subject to this Policy. Similarly, your Personal Information may be passed on to a successor in interest in the unlikely event of a liquidation, bankruptcy or administration.
Please remember that when you share information publicly on an Arxada website, for example a comment on a blog post, it may be indexable by search engines, including Google, which may mean that the information is made public.
5. Data Security
Arxada takes what it considers to be reasonable technical and organizational measures to help protect Personal Information against unauthorized access, accidental loss, or unlawful processing. While no system can be guaranteed to be completely secure, we aim to implement safeguards appropriate to the nature of the data and the risks involved.
We have implemented measures intended to protect our user database. However, the security of your information also depends on you. If you have a user account for the Arxada website, you are responsible for:

6. Data Retention
Arxada may store Personal Information with a third party in encrypted form on secure servers. This includes storing data on servers owned by Microsoft which may be in locations outside of your own country. For the purpose of sending e-mails to you, provided that you have subscribed to Arxada's news updates on the website, Arxada may give your name and e-mail address to agencies appointed by Arxada. These agencies are not authorized to store and/or use your Personal Information for any other purposes than for the sending of e-mails on behalf of Arxada.
We will retain your Personal Information for as long as necessary for the processing purposes for which they were collected, processed and/or used and any other associated purposes (for example, some transaction details and correspondence may be retained until the time limit for claims in respect of the transaction has expired or in order to comply with regulatory requirements regarding the retention of that data). Our retention periods are based on business needs and applicable laws.
7. Personal Information of Children
Without a parent's or guardian's consent, no Personal Information should be submitted to our website by children. Arxada will not seek to collect or use Personal Information from children under the age of eighteen (18) years.
8. What are your rights and how can you exercise them?
You have a right to access and to obtain information regarding your Personal Information to request details regarding some or all of the Personal Information we collect and process about you. You may also request the correction of your Personal Information.
Additionally, you have the right to:

· request the erasure of your Personal Information
· request restriction on the processing of your Personal Information
· withdraw your consent where Arxada obtained your consent to process Personal Information

Please note that these rights are subject to legal requirements and restrictions and may not always be fully available.
Where we process your Personal Information on the basis of your consent, or where such processing is necessary for entering into or performing our obligations under a contract with you, you may have the right to request that your Personal Information be transferred to you (“data portability right”).
9. How do we use your Personal Information for marketing purposes?
We may contact you by mail, telephone, SMS, text/picture/video message, WhatsApp, fax, email about products, services, promotions, special offers, events, webcasts, conferences and charitable causes that may be of interest to you. In those instances, where Personal Information is processed for direct marketing purposes, your right to object extends to direct marketing, including profiling to the extent it is related to such marketing. 11. Export of Personal Data from the EEA, Switzerland or the UK
To the extent required for purposes of the processing, Personal Information collected in the territory of the European Economic Area (EEA), Switzerland or the UK may be accessed in, transferred to, and/or stored at, any global destination outside the European Economic Area (EEA), Switzerland or the UK where data protection laws may be of a lower standard than in the EEA, the UK or Switzerland. Some countries outside the EEA, Switzerland or the UK have been approved by the European Commission, the UK or Switzerland as providing essentially equivalent protections to EEA/Swiss/UK data protection laws and therefore no additional safeguards are required to export Personal Information to these jurisdictions.

If required for the provision of the Services and subject to the limited purposes set out here, Arxada may share your Personal Information with third party service providers, consultants or agents. Where Arxada companies or third-party service providers, consultants or agents are located outside of the EEA or Switzerland or the UK or an approved third country, any transfer of Personal Information will be subject to the conditions set out above.

Addendum: Additional Information for California Residents
This Addendum is intended to comply with data privacy laws and regulations, including the California Consumer Privacy Act as amended by the California Privacy Rights Act and its implementing regulations (collectively, the “CCPA”), that are applicable to residents of the State of California. This Addendum addresses our processing of Personal Information relating to individuals who interact with us in an individual or household capacity and individuals who apply to work with us. Our current and former employees should consult our California Employee Privacy Notice for information about our processing of their Personal Information.
Certain terms in this section of the Policy have the meanings given to them in the CCPA.
Personal Information We Collect. We collect, and in the preceding 12 months, depending on your interactions with us, we may have collected the following categories of Personal Information:
3. Demographic data, including protected classifications under California or federal law, such as gender, sex, race, age (40 and over), ethnic origin, religion, marital status, sexual orientation, medical condition, disability, citizenship status, nationality, and veteran or military status.

We do not collect or process sensitive personal information (as that term is defined by the CCPA) for the purpose of inferring characteristics about individuals.
By providing us with Personal Information, you agree that you are authorized to provide us with such information. Where the information you are providing pertains to someone else, you acknowledge that you are required to inform them of the contents of this Privacy Policy.
Sources of Personal Information. We collect and receive, and during the 12-months preceding the effective date of the Privacy Policy may have collected and received the Personal Information of California residents from the entities and through the mechanisms identified in “How Arxada collects and uses your Personal Information,” above.
Purposes for Using, Disclosing, and Otherwise Processing Personal Information. We may use, disclose, or otherwise process, and may have used, disclosed, or otherwise processed in the 12-month period prior to the effective date of this Policy, Personal Information of California residents for the purposes described in “How and why we use your Personal Information & when we share your Personal Information,” above.
“Sales,” “Sharing,” and Disclosures of Personal Information for a Business Purpose. We do not:
· Sell job applicants’ Personal Information;
· Share or disclose job applicants’ Personal Information for cross-context behavioral advertising;
· share or disclose individuals’ sensitive information for purposes other than those permitted by the CCPA as set out in Cal. Code Regs. tit. § 7072(m); or
· sell or share Personal Information of individuals under the age of 16.
We generally disclose, and in the preceding 12 months we may have disclosed, the categories of Personal Information listed above at “Personal Information We Collect” to the categories of entities described in “How and why we use your Personal Information & when we share your Personal Information,” for the business or commercial purposes described therein.
Our business model does not include selling Personal Information to third parties in exchange for money. However, we may share online activity related to individuals who are not interacting with us as job applicants, such as cookies and the advertising identifier associated with the individual’s computer or mobile device, with our advertising partners to show ads that are targeted to their interests. Under California law, sharing Personal Information with partners in exchange for some benefit, such as providing more relevant ads based on information collected across websites, can be considered a “sale” or “sharing” in some circumstances. As such, we may be considered to “sell” or “share” your Personal Information for targeted or cross-context behavioral advertising. The types of information that we collect and may “sell” or “share” for cross-context behavioral advertising and may have disclosed for those purposes in the preceding 12 months, include: Identifiers; Internet or other electronic network activity information; Commercial Information; and Inferences. The recipients of that information are our marketing and advertising partners, including the platforms that enable or participate in targeted and cross-context behavioral advertising, and social media platforms.
California residents may opt out of the “sale” or “sharing” of Personal Information as described in the “Consumer Rights,” section discussed below. Please note that the right to opt out only applies to “sales” or “sharing” of Personal Information and does not restrict our ability to disclose information to third parties for valid business purposes.
Consumer Rights. California residents have the following privacy rights regarding their Personal Information:
You can exercise your privacy rights by submitting a request to us by emailing us at: privacyofficer@arxada.com; or asking our Data Privacy Office for a written request form. To help protect the security of your Personal Information, we will take steps to verify your identity before granting access to your Personal Information or complying with your request. We may require you to provide us with identifying information for you such as personal email address, personal telephone number, employee identification number, and/or other information that we can match with the Personal Information we have collected about you to verify your identity. If you ask us to provide you with specific pieces of Personal Information, we may require you to sign a declaration under penalty of perjury that you are the individual whose Personal Information is the subject of the request and provide appropriate proof of identity.
For requests to know or delete information about a child under the age of 13, we accept requests for information regarding minors under the age of 13 if we can determine that such requests were submitted by a parent or guardian.
You may use an authorized agent to exercise your privacy rights. We will require your authorized agent to provide us proof of your authorization, which may take the form of either: (1) a power of attorney authorizing the authorized agent to act on your behalf, or (2) your written authorization permitting the authorized agent to exercise your privacy rights on your behalf. Further, we may require you or your authorized agent to provide us with identifying information to verify your identity. We may also require you to either verify your own identity directly with us or directly confirm with us that you provided the authorized agent permission to submit the request.
Within 10 days of receiving your request to delete, correct, or know, we will confirm receipt of your request and provide information about how we will process your request. Generally, we will respond to your request within 45 days. If we need more time to respond, we will provide you with notice and an explanation of the reason we need more time to respond. We may deny your request if we cannot verify your identity or are legally permitted to deny your request. If we deny your request, we will explain the basis for the denial, provide or delete any Personal Information that is not subject to the denial, and refrain from using the Personal Information retained for any purpose other than permitted by the denial. We will maintain a record of your request and our response for 24 months. To the extent permitted by law, we may charge a reasonable fee to comply with your request if the request is manifestly unfounded, excessive, or repetitive.
As discussed above, we do not sell your Personal Information for monetary consideration. However, to the extent we “sell” or “share” your Personal Information (as those terms are defined under CCPA), California residents have the right to opt out of that “sale” or “sharing” on a going-forward basis at any time. To exercise this right, visit our Privacy Preference Center and disable the “Advertising Cookies” category if it is not already disabled.
You may also be able to restrict the collection of Personal Information through your device’s operating system or by disabling cookies but doing so may prevent you from using the functionality of the websites. If your browser supports it, you can turn on the Global Privacy Control (GPC) to opt out of the “sale” or “sharing” of your Personal Information. We honor the GPC and other universal opt out signals where we are required to do so by applicable law, and we process these signals in a frictionless manner. These are signals you can send from your browser to a website to convey your choice to exercise certain opt-out rights granted by individual states. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use. However, please note that if you have the GPC signal enabled, you will not receive advertisements tailored to your interests.
Some internet browsers have a “Do Not Track” feature that lets you tell websites that you do not want to have your online activities tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, our website does not currently interpret, respond to or alter its practices when it receives “Do Not Track” signals.
Even if you opt out of the sharing or processing of your Personal Information for cross-context behavioral advertising, you may still see our ads online at other sites and apps, and we may still base aspects of ads on your interactions with us and the websites.

This Addendum to Privacy Policy for China(“China Addendum”) applies only when you are within the territory of the People’s Republic of China (“PRC”). It is a supplement to this Privacy Policy and includes information such as your rights under the Personal Information Protection Law of the People’s Republic of China. In case of any inconsistencies between this China Addendum and this Privacy Policy, the content of this China Addendum shall prevail.

If you order products from us, to help you complete transactions smoothly,we may collect your name, physical mailing address, telephone number, your credit card or other payment information, purchase history, shopping cart information and information provided to customer service personnel or through customer service tools of Arxada.

If you apply to work with us, in the application process, Arxada requests your name, address, city, country, postal code, telephone number and email address. We also request information regarding your job preferences, current and prior employment, referral source, competencies, education, language proficiencies, professional qualifications, analytical skills. Additionally, depending upon your location or the location of the job, we may request optional references, self-identification information and additional information allowing us to evaluate your application.
